1. Acceptance of Terms
By accessing or using SalesMee ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you may not use our services.
2. Description of Service
SalesMee provides a communication and management platform that enables businesses to connect with their clients through real-time chat, order management, booking management, and related services. The platform serves both business accounts and client (customer) accounts.
3. Account Registration and Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate, current, and complete information during the registration process.
You may register using email and phone OTP, Google Sign-In, or Facebook Login. By using these authentication methods, you agree to the respective terms and privacy policies of Google and Facebook.
4. User Responsibilities
- You agree not to use the Platform for any unlawful purpose or in violation of any applicable laws.
- You agree not to interfere with the proper functioning of the Platform.
- You agree not to impersonate any person or entity or misrepresent your affiliation with any person or entity.
- You agree not to upload or transmit viruses, malware, or any other malicious code.
5. Business-Client Relationships
SalesMee acts as a platform facilitating communication and transactions between businesses and their clients. We are not a party to any agreements made between businesses and clients through the Platform. Businesses are responsible for their products, services, pricing, and fulfillment of orders and bookings.
6. Orders, Payments, and Refunds
Orders placed through the Platform are subject to confirmation by the business. Payment terms are agreed upon between the business and the client. SalesMee may process payments on behalf of businesses using third-party payment processors.
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
Cancellation and refund policies are determined by each individual business. Please refer to our Refund Policy for more details. SalesMee is not responsible for resolving disputes between businesses and clients regarding orders, payments, or refunds.
7. Bookings and Cancellations
Bookings made through the Platform are subject to confirmation by the business. Cancellation policies are determined by each business. SalesMee facilitates the booking process but is not responsible for the delivery of booked services.
8. Intellectual Property
The Platform and its original content, features, and functionality are owned by SalesMee and are protected by international copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written consent.
9. Third-Party Services
The Platform integrates with third-party services including:
- Google: Authentication via Google Sign-In and advertising via Google Ads are subject to Google's Privacy Policy.
- Facebook: Authentication via Facebook Login is subject to Facebook's Data Policy.
We are not responsible for the practices of these third-party services.
10. Limitation of Liability
To the maximum extent permitted by law, SalesMee shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Platform. Our total liability for any claims under these terms shall not exceed the amount paid by you to us in the 12 months preceding the claim.
11. Termination
We may terminate or suspend your account at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Upon termination, your right to use the Platform will immediately cease.
You may terminate your account at any time by contacting us or using the account deletion feature.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Republic of Kenya, without regard to its conflict of law provisions.
13. Changes to Terms
We reserve the right to modify these terms at any time. We will notify users of material changes via email or through the Platform. Continued use of the Platform after changes constitutes acceptance of the new terms.
